Sexual abuse allegations against a Nellis Air Force Base officer have been dropped in military court, but he could still face discharge from the military.

Lt. Col. Kevin DiFalco was accused by the police of grooming a girl, raping her, and committing lewd acts in front of her in 2022. The girl reported that DiFalco sent her underwear and bikinis with notes asking her to wear them. She also stated that he raped her multiple times, leading her to develop an eating disorder and attempt to overdose due to the abuse.

Although DiFalco could not be reached for comment, he recently denied the allegations in an interview with a military news website.

Initially, DiFalco faced charges of lewdness in the presence of a child and child abuse or neglect in Las Vegas Justice Court. However, the charges were denied by prosecutors in October 2022, and the case was transferred to the military court.

During the court-martial process, DiFalco was charged with sexual assault, sexual abuse of a child, obstructing justice, and indecent exposure, according to Air Force spokesperson Maj. Lauren Ott. The charges were referred to the court-martial on Jan. 22, 2024, but were withdrawn and dismissed on June 7.

The charges were dismissed without prejudice, allowing the Air Force the option to prosecute them at a later time. Ott cited pending administrative proceedings as the reason for the withdrawal, without providing further details.

An administrative Board of Inquiry hearing is set for September, where the board will have the authority to listen to testimony, assess evidence, and determine whether DiFalco should be discharged. In the meantime, he remains on active duty at Nellis as a special projects officer.
