A Federal Bureau of Investigation special agent named Eduardo Valdivia has been accused of sexually assaulting two women, according to police and court documents. Valdivia was previously found not guilty of attempted murder for shooting a man on a Metro subway train near Washington, D.C., four years ago. He has now been arrested in Maryland.

The FBI has suspended Valdivia while the Montgomery County Police Department conducts its investigation. The bureau emphasized that it takes criminal allegations and misconduct seriously and is cooperating with law enforcement on the case. Valdivia had previously faced charges of attempted second-degree murder and other offenses related to the shooting incident in 2020, but he was acquitted after claiming self-defense.

The recent charges against Valdivia include two counts of second-degree rape, with alleged incidents occurring in May and September of 2024. His defense attorney, Robert Bonsib, confirmed the arrest on sexual assault charges but emphasized that all allegations should be substantiated with evidence before judgment is passed. The Montgomery County Police Department has not disclosed further details about the case but believes there may be additional victims.

Valdivia, who resides in Gaithersburg, Maryland, remains in custody following his initial court appearance. His attorney revealed that Valdivia joined the FBI in 2011 and was promoted to a supervisory special agent in 2019. Despite his acquittal in the previous shooting case, he continued working as an FBI agent until his recent arrest.

The shooting incident in 2020 involved Valdivia shooting and injuring an unarmed passenger during a confrontation on a train in Maryland. Valdivia claimed self-defense, stating that he felt threatened by the approaching passenger and acted to protect himself. The wounded man underwent significant surgery to address his injuries, including the removal of parts of his spleen, colon, and pancreas.

The defense attorney maintained that Valdivia’s actions were justified given the circumstances and the potential threat to his safety. Valdivia will appear in court for a bond hearing, and the investigation into the sexual assault allegations is ongoing, with law enforcement urging any additional victims to come forward.

The case involving Valdivia highlights the complexities of legal proceedings and the importance of thorough investigations to uncover the truth. The FBI’s commitment to addressing criminal behavior within its ranks is evident in its response to the allegations against Valdivia. As the legal process unfolds, more details may emerge, shedding light on the events leading to his arrest and the subsequent charges.
