A New Mexico judge has upheld the involuntary manslaughter conviction of movie armorer Hannah Gutierrez-Reed in the tragic shooting incident involving actor Alec Baldwin on the set of the film “Rust.” Despite Gutierrez-Reed’s request to dismiss the conviction or have a new trial based on alleged misconduct and suppression of evidence by law enforcement, the judge ruled in favor of upholding the conviction.
The judge’s decision comes after Baldwin’s trial was halted and ended in July due to misconduct by police and prosecutors, as well as evidence being withheld from the defense. Gutierrez-Reed was convicted by a jury earlier this year and was sentenced to the maximum 18-month penalty. She currently has an appeal of her conviction pending in a higher court.
Prosecutors have placed blame on Gutierrez-Reed for bringing live ammunition onto the set of the film and for not following proper gun safety protocols. However, Gutierrez-Reed’s defense team argued that the case should be reconsidered as prosecutors failed to disclose potentially exculpatory evidence.
In addition to the involuntary manslaughter conviction, Gutierrez-Reed was also acquitted of tampering with evidence in the “Rust” investigation. She has pleaded not guilty to a separate felony charge related to allegedly carrying a gun into a bar where firearms are prohibited, with a proposed plea agreement awaiting court review.
The tragic incident occurred when Baldwin, the lead actor and co-producer of “Rust,” was handling a gun during a rehearsal on set, resulting in the death of cinematographer Halyna Hutchins and injuring director Joel Souza.
